THE INFORMATION WE COLLECT

Beyond Control Swimwear collects your full name, address, city, state, zip, country, e-mail address, shipping information and credit card information. You can decline to submit personal information to any of our services, in which case Bleu Rod Beattie may not be able to provide any services to you.
PURCHASE RELATED INFORMATION
Beyond Control Swimwear also collects information about the credit card used when making a purchase, including card number, card type, cardholder name, billing address and expiration date, in order to bill you for your purchases through the Site.
E-MAIL NOTIFICATIONS
If you choose to receive communications from Beyond Control Swimwear about special promotions when registering at beyondswimwear.com, we may use your e-mail address to send you communications about surveys, contests and marketing information about Beyond Control Swimwear. We may use your e-mail address or telephone number to contact you about your purchase and availability.

DISPUTE RESOLUTION
Mindful of the high cost of litigation, not only in dollars but also in time and energy, both you and beyondswimwear.com agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the Site, or the breach, enforcement, interpretation, or validity of this Agreement or any part of it ("Dispute"), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. Notice shall be sent

(2) to you at: your last-used billing address or the billing and/or shipping address in your online profile.
Both you and beyondswimwear.com com agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any litigation or filing any claim against the other party.
CHOICE OF LAW
This Agreement shall be construed in accordance with the laws of the State of New York, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and/or federal courts of the State of New York. The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of beyondswimwear.com’s right to require strict observance of each of the terms herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between us relating to your use of the Site.
TERMINATION
These terms are effective unless and until terminated by either you or beyondswimwear.com. This Agreement may be terminated at any time. beyondswimwear.com may also terminate this Agreement at any time without notice, and accordingly may deny you access to our Site, if in our sole judgment you fail to comply with any term or provision of the Agreement. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.

RETURNS POLICY
IS IT EASY TO RETURN ITEMS?
You have 21 days from the date that you receive your package to initiate a return. Once your return is authorized, you'll receive step-by-step instructions and a prepaid shipping label via email.
HOW SOON WILL I GET MY REFUND?
You'll get your refund typically within 15 days after our warehouse center receives and inspect the item.
WHAT IS AN “INSTANT CREDIT”?
While processing a return via the Returns Center, you may order an Instant Credit code along with and shipping label. If you do receive a code, you can use this credit to buy something new without waiting for your return refund. Once we receive your original item(s), we'll deactivate any unused Credit and refund the outstanding balance to your original payment method.
HOW DO I USE “INSTANT CREDIT”?
You'll use your Instant Credit code at checkout, similar to a gift card. The Credit amount will be for the amount of the items being returned. If you use Credit and the price of the new order is less than your Credit amount, you will be refunded the remaining amount to your original payment method.
WHAT HAPPENS IF I DON’T USE MY “INSTANT CREDIT”?
Instant Credit comes with no strings attached. Any unused portion of the Credit will be refunded back to your original payment method.
WHAT ITEMS ARE RETURNABLE?
- Items purchased in the last 21 days.
- Any item that is NOT part of our Swim Sale - Final Sale.
WHAT ITEMS ARE NON-REFUNDABLE?
- Items marked as final sale.
- Worn, altered, or washed items cannot be returned or exchanged.
- Gifts or promotional items with retail value.
- We reserve the right to deny a refund if the returned merchandise does not meet our requirements.
WHAT HAPPENS IF THE ITEM IS RECEIVED DAMAGED AT OUR WAREHOUSE?
You will not be eligible for a refund. If you previously selected the instant credit option, our returns vendor - Returnly - will send you an invoice for the item you purchased. If you would like to receive your damaged item back, you will be responsible for the shipping cost.
WHAT HAPPENS IF WE RECEIVE NON-AUTHORIZED PRODUCTS IN ONE RETURN PACKAGE?
You will only be eligible for a refund for the number of units authorized for the return. If you send more items in your package, we are not responsible for additional orders or products. You have to do 1 return per order to receive a refund or instant credit.
CANCELLATIONS
You are eligible to cancel your order up to 8 business hours after placing your order.
Please note that we do not offer free returns. The return shipping label will be deducted from your refund or instant voucher. The return shipping label value will be according to your item weight and dimensions according to the USPS service.
Shipping and handling costs are non-refundable. If you receive a refund, all shipping and handling costs may be deducted from your refund.
We do not process any Free returns or exchanges unless you receive a damaged item from our warehouse or the wrong product.
